Booking Terms and Conditions
YOUR CONTRACT IS WITH WATERFRONT GUEST HOUSE
The Company means Waterfront Guest House as well as all the sub-contractors they use.
The Client means all persons named on the booking form.
Major Change means a significant change of activity or accommodation
1. GENERAL
Quotes are valid for 7 days from original date of quote. Rates are quoted in South African Rand. Rates are subject to change without prior notification.
2. HOW TO BOOK
When you make a booking, you must complete a booking form, accepting on behalf of all your party the terms of these booking conditions. No contract shall exist between the Company until fifty percent (50%) deposit of the total invoice has been paid or a voucher has been issued (for the total amount) and the Company has confirmed the Client’s booking form with a confirmation letter.
3. PAYMENT
Payment can be made as a direct deposit into the bank account of Waterfront Guest House. A fifty percent (50%) deposit is required to secure your booking. No credit card facilities are available. The full amount due should be paid no later than fourteen (14) days prior to the date of the booked accommodation. Late applicants may however obtain bookings on a ‘space available’ basis. Guests booking within the period of fourteen (14) days prior to arrival need to pay the balance immediately to secure their place.
4. TRANSACTION CURRENCY
The Company is a South African merchant and advertises our prices in ZAR currency.
5. IF YOU CHANGE YOUR BOOKING
If, after our confirmation letter has been issued, you wish to change your booking with us in any way, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be from the person who made the booking. You will be asked to pay an administration charge per person and any further cost we incur in making this alteration. You should be aware that these costs could increase the closer to the date booked that changes are made and you should contact us as soon as possible.
6. CANCELLATIONS BY THE CLIENT
Cancellation of a booking must be made in writing, fax or email by the person signing the booking form and is not effective until the Company receives such cancellation. In the event of cancellation, the following deduction rates charges will apply: • Up to 14 days prior to arrival: 50% of total fare • 13 to 7 days prior to arrival: 75% of total fare • 6 to 0 days prior to arrival: 100% of total fare If the Client fails to meet his secured accommodation booked no refund will be made. If the Client cancels a booking, the deposit is not transferable to any other person. If the full account is not paid within 14 days from arrival, the Company reserves the right to treat the booking as cancelled.
7. CANCELLATIONS BY THE COMPANY
The Company reserves the right in any circumstances to cancel the booked accommodation. In the instances where the Company cannot provide the accommodation which was booked, the Company will return to the Client all moneys paid, which shall constitute the full extent of the Company’s liability to the Client.
8. ALTERATIONS TO ITINERARIES
When a major change becomes necessary, notification of such alterations will be sent to the Clients agent or the Clients last known address as soon as the Company becomes aware. The Company will not be responsible for any compensation to the Client, if the Company is forced to cancel or in any way change the booking due to force majeure, namely war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or external circumstances beyond the Company’s control.
9. ALTERATION TO BOOKING CONDITIONS
No employee or representative of the Company has any right neither to alter, vary or waive any of these Conditions, nor to undertake any liability whatsoever on behalf of the Company, unless such be in writing and signed by the Owner of the Company.
10. HEALTH
The Client acknowledges and being aware of potential diseases and hereby confirms that he or she is medically fit and in good health. Any Client with a pre-existing medical condition or illness must declare the true nature of such condition at the time of booking and make arrangements for the provision of any drugs or other cause of treatment which may be required during his/her stay at Waterfront Guest House. The Company and its representatives will treat all information in the strictest confidence.
11. VACCINATIONS
The Client must take all necessary inoculations and precautions as required.
12. BAGGAGE
All baggage and personal effects are at all times at the Client’s risk and the Company cannot accept any liability for any loss or damage to baggage or personal effects.
13. TRAVEL DOCUMENTATION
It is the responsibility of the Client to be in possession of a valid passport, visa permits, vaccination and other medical certificates, and all other travel documents, including traveler’s cheques where applicable. The Company does not accept any responsibility for changes in regulations for visas or any particular requirements for visas. The Company cannot be held responsible for the failure of the Client to obtain the necessary documentation. Should a Client be refused entry to any of the activities due to incorrect or incomplete documentation, the Company is not liable for any costs of such delays or repatriation costs for the Client.
14. INSURANCE
Travel and cancellation insurance is recommended. A Client must arrange his or her own insurance with a reputable insurer, with protection for the full duration of the accommodation, to cover personal injury, medical expense, repatriation expense, loss of luggage and the expenses associated with cancellation or curtailment of an booking. If a Client becomes ill, all hospital expenses, doctors’ fees and repatriation costs are the Client’s responsibility and the Company shall not be liable for any refund of the accommodation cost.
15. LIABILITY
The Client agrees that this Company and its members shall not be responsible for loss or damage to property or injury or illness to the Client or loss of life or consequential damages which might occur from any cause whatsoever. The Client and his / her dependants, heirs, executors, administrators and assigns hereby indemnify and hold blameless this Company, its members, associates, employees, representatives, organizers, helpers, agents from all liability for any or all claims whatsoever and howsoever arising and without limitation from any claim (including any consequential claim) arising from any delay, loss or damage to property or injury or illness or death arising from any cause whatsoever related to or occurring during your stay at Waterfront Guest House.
16. INFORMATION
Information on the booking form, brochures and website is given in good faith by the Company, and is based on the latest information available at the date of publication. The Company reserves the right to change any of the facilities described on the booking form, brochures or website without becoming liable for compensation or refund. While every endeavour is made to keep to the prices advertised, the Company reserves the right to increase the rates at any time due to any unforeseen increases or exchange rate fluctuations to which it may be subjected.
17. JURISDICTION AND LAW
This contract shall be interpreted according to the laws of the Republic of South Africa.
